German Court Rules Apple’s Carbon-Neutral Ads Misleading

A German court has ruled that Apple’s advertisements describing the Apple Watch as “CO2 neutral” are misleading, marking a setback for the tech giant as it faces growing scrutiny over its environmental claims. The decision, delivered by a Frankfurt commercial court, found that Apple’s reliance on forestry offsets in Paraguay to justify the claim did not meet consumer expectations shaped by global climate goals.


The court noted that consumers would reasonably assume such claims meant the product’s carbon footprint would be balanced until at least 2050, in line with the Paris Agreement. However, the offsets Apple used depended on eucalyptus plantations leased only until 2029, with no guarantee of extension. While Apple highlighted buffer pools of carbon credits designed to insure against risks, judges ruled these measures could not guarantee the long-term existence of the project.


The case was brought by Environmental Action Germany, whose director Jürgen Resch argued the ruling would help curb corporate greenwashing. Apple, meanwhile, emphasized that its broader climate strategy had been upheld, reiterating its commitment to achieving full supply chain carbon neutrality by 2030 through clean energy and low-carbon design.

The ruling comes as Apple also faces a class-action lawsuit in the U.S., where consumers allege they paid premiums for Apple Watches marketed as carbon neutral. That case, involving forestry projects in China and Kenya, is set for a hearing in November.


Amid regulatory pressure, Apple has already pledged to phase out carbon-neutral marketing claims ahead of tougher European Union rules taking effect in 2026. Still, the company’s approach has won support from groups like the Environmental Defense Fund, which called Apple’s strategy “a leadership approach” in global decarbonization.
